Legal: Are you prepared for holiday trading?

With the festive season round the corner, hospitality businesses will be looking to maximise their trading hours over the busy Christmas and New Year period.
While some licences will already allow seasonal extensions of hours over Christmas and New Year others may not. You should check your premises licence to see what your permitted hours are over the festive period, and if you do wish to extend your trading hours then you should apply for a temporary event notice (TEN).
TENs should be applied for at least 10 working days before the proposed event. Late TENS can be made on no less than 5 working days’ notice but if a counter notice – objection – to the application is served by the Police then the application automatically fails. If an objection to a standard notice TEN is submitted, then a hearing of the application must take place. In short, the sooner you apply the better!

It’s important to remember that, in the course of a calendar year, a premise is permitted to apply for a maximum of 15 TENs provided that the total duration of ALL events does not exceed 21 days.
